Refer-a-Friend Program Terms of Use
These Terms of Use (this “Agreement”) are made by and between Fidium (“Fidium,” “we” and “our”) and you (“you” or “your”). This Agreement contains the terms and conditions that govern your use of our Refer-a-Friend program (the “Referral Program”). The Referral Program rewards you, as an advocate for our services (an “Advocate”), for referring new customers to Fidium, or for being referred by someone else to become a new customer of Fidium (a “Referred Friend”).
BY PARTICIPATING IN THE REFERRAL PROGRAM, INCLUDING WITHOUT LIMITATION, ATTEMPTING TO ACCESS OR USE THE PROGRAM FORMS, SHAREABLE SOCIAL MEDIA OR EMAIL CONTENT, YOU AGREE, ON YOUR OWN BEHALF PERSONALLY, AND ON BEHALF OF ANY ENTITY FOR WHICH YOU ARE AN AGENT OR YOU APPEAR TO REPRESENT, THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU MAY NOT PARTICIPATE IN THE REFERRAL PROGRAM.
FIDIUM RESERVES THE RIGHT, AT ANY TIME, WITH OR WITHOUT NOTICE TO YOU, TO MAKE CHANGES TO THIS AGREEMENT OR THE REFERRAL PROGRAM IN FIDIUM’S SOLE DISCRETION. YOUR CONTINUED PARTICIPATION IN THE REFERRAL PROGRAM CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. THE MOST CURRENT VERSION OF THIS AGREEMENT, WHICH SUPERSEDES ALL PREVIOUS VERSIONS, CAN BE REVIEWED BY CLICKING ON THE “REFER-A-FRIEND PROGRAM TERMS OF USE” HYPER-LINK LOCATED UNDER THE "TERMS AND POLICY" HYPER-LINK ON THE WEBSITE.
TERMS OF USE
1. ELIGIBILITY & QUALIFIED REFERRALS
Individuals must be must be 18 years or older and a resident of one of the fifty United States, the District of Columbia or Puerto Rico to participate in the Referral Program. Individuals may not participate in a Referral Program where doing so would be prohibited by applicable law. Participation in the Referral Program may require users to submit personal information about themselves and their friends, such as name and email address.
The Advocate and the Referred Friend cannot be the same person (for example, by using a different email address).
The Advocate. Any U.S. resident who can access FidiumFiber.com may act as an Advocate of Fidium and use our Referral Program tools to share Fidium information. The Advocate is eligible for a Reward Payment when a Referred Friend completes an online order and the order is installed from the referral link provided to them by the Advocate.
The Referred Friend. Individuals whose service address is located at a Fidium Fiber eligible location and can order online will be eligible to receive Reward Payments for ordering new Fidium service online at FidiumFiber.com after being referred by an Advocate. To be eligible for a Reward Payment, the individual must use the link to FidiumFiber.com provided to them by the Advocate to order services and be a new customer of Fidium. Referred Friends are eligible for a Reward Payment for installed orders only. Referred Friends are not eligible for a Reward Payment for submitting a pre-order for future Fidium service.
2. RESTRICTIONS ON USE
No Spam. The Advocate must comply with all up-to-date “SPAM” laws. For example, emails sent from the Advocate to potential referrals must be created and distributed in a personal manner. Any distribution of the Advocate’s referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate exclusion from the Referral Program.
Right to Close Accounts or Void Rewards. Fidium reserves the right to close accounts or void referrals and rewards if we suspect that the Referral Program was used in an unauthorized or fraudulent manner or if we believe rewards were earned in any way that violates this Agreement or applicable law.
3. REWARD PAYMENTS
Payment Amounts and Payment Types. Rewards are payable to participants in the form of a gift card or charitable donation (“Reward Payments”). No cash, checks or money orders will be distributed. The amount of the Reward Payment may change from time to time. The amount paid will match the currently advertised reward at the time the Advocate or the Referred Friend qualify for a Reward Payment. The fulfillment, redemption and use of gift card Rewards by participants are governed by separate terms and conditions established by the Reward vendor.
Taxable Income. All Reward Payment recipients, including employees of Consolidated Communications, are responsible for any and all tax liability resulting from Referral Rewards. Rewards from this program are capped at $599/year for each participant.
Right to Cancel Program or Change Terms. Fidium reserves the right to cancel the Referral Program or to change the terms of this Agreement at any time in its sole discretion. Unredeemed referral rewards may be cancelled or expire in accordance with the terms and conditions of the gift card.
The Advocate. Any U.S. resident who can access FidiumFiber.com may act as an Advocate of Fidium and use our Referral Program tools to share Fidium information. The Advocate is eligible for a Reward Payment when a Referred Friend completes an online order and the order is installed or submits an online pre-order form for potential future new Fidium service from the referral link provided to them by the Advocate.
The Referred Friend. Individuals whose service address is located at a Fidium Fiber eligible location and can order online will be eligible to receive Reward Payments for ordering new Fidium service online at FidiumFiber.com after being referred by an Advocate. To be eligible for a Reward Payment, the individual must use the link to FidiumFiber.com provided to them by the Advocate to order services and be a new customer of Fidium. Referred Friends are eligible for a Reward Payment for installed orders only. Referred Friends are not eligible for a Reward Payment for submitting a pre-order for future Fidium service.
Reward payment timing. The reward payment on both the advocate and friend can take up to 100 days to be rewarded.
